1. WHAT INFORMATION DO WE COLLECT?
Personal information you disclose to us
In Short: We collect personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.
Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:
- names
- email addresses
- passwords
- contact or authentication data
- billing addresses
- VAT or tax id
- organization details, such as name and logo.
Sensitive Information. We do not process sensitive information.
Payment Data. We may collect data necessary to process your payment if you choose to make purchases, such as your payment instrument number, and the security code associated with your payment instrument. All payment data is handled and stored by Stripe. You may find their privacy notice link(s) here: https://stripe.com/privacy.
Social Media Login Data. We may provide you with the option to register with us using your existing social media account details. If you choose to register in this way, we will collect certain profile information about you from the social media provider, as described in the section called "HOW DO WE HANDLE YOUR SOCIAL LOGINS?" below.
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information automatically collected
In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes. If you accept analytics cookies and sign in to the BrandRetriever app, our analytics provider (PostHog) links your account's analytics, including events from the browser extension and our servers, to your name, email address, and organization. Withdrawing consent stops analytics collection in your browser; we remove this link and the data already collected on request.
Like many businesses, we also collect information through cookies and similar technologies. You can find out more about this in our Cookie Policy: brandretriever.com/legal/cookies.
The information we collect includes:
- Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
- Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
- Location Data. We may infer your approximate location, such as your country or region, from your IP address. We do not collect your precise location.
- Error and diagnostic data. Technical information about errors and performance problems in the app and browser extension, used to find and fix bugs and keep the service running. This includes details such as your user and organization identifiers (linked to your account as described above), what went wrong and where, and the version of the app or extension.
INFORMATION WE RECEIVE FROM OTHER SOURCES
If you sign in with Google, we receive your name, email address, and profile image from Google. If an organization owner or admin invites you, we receive your email address and role. Stripe provides payment, subscription, and tax details. We do not buy personal information from data brokers or use information from other sources for targeted advertising.
Google API
Our use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.
2. HOW DO WE PROCESS YOUR INFORMATION?
In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We process the personal information for the following purposes listed below. We may also process your information for other purposes only with your prior explicit consent.
We process your personal information for a variety of reasons, depending on how you interact with our Services, including:
- To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order. (Retention period: For as long as the account is active. Account data is deleted on request or within 90 days after the account is closed, except where we need to keep it for legal or security reasons.)
- To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service. (Retention period: For as long as the customer's organization has an account. Records of imports and image usage may be kept after the account ends; we delete them on request. Credentials for connected services are deleted or wiped when the connection is removed.)
- To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service. (Retention period: Support messages are kept for as long as they're useful for handling follow-up questions and keeping a record of support history. We delete them on request, unless we need to keep them for legal reasons.)
- To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information. (Retention period: Your email address is kept as long as your account is active. Our email provider keeps delivery records under its own retention period.)
- To fulfill and manage your orders. We may process your information to fulfill and manage your orders, payments, returns, and exchanges made through the Services. (Retention period: For as long as required by tax, accounting, and other legal obligations, generally up to seven years. Our payment processor keeps its own records under its own policy.)
- To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services. (Retention period: Feedback is kept for as long as it's useful for improving the product. We delete it on request.)
- To send you marketing and promotional communications. We may process the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. To send relevant onboarding, product, and account emails, we share your name, email address, and information about how you use BrandRetriever, such as setup steps you complete, services you connect, people you invite, and changes to your subscription, with our email provider. You can opt out of our marketing emails at any time. For more information, see "WHAT ARE YOUR PRIVACY RIGHTS?" below. (Retention period: For as long as your account is active; we delete it on request. If you unsubscribe, we stop sending you marketing emails. After your account is deleted, we keep only your email address on a suppression list so we can honor your opt-out.)
- To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention, and automated checks on our sign-in and sign-up forms that help tell people from bots. (Retention period: Security and audit logs, and records of account activity we use to protect the service, are kept for as long as they're useful for detecting abuse, investigating security incidents, troubleshooting, and meeting legal obligations. Background job records are deleted after 30 days. Error reports are sent to our analytics provider (PostHog) and kept for the retention period we configure there. Our websites send them from your browser only if you have accepted analytics cookies; our servers and browser extension send them to keep the service secure and working.)
- To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them. (Retention period: Usage data is kept for as long as it remains useful for understanding how the service is used and improving it. It may be linked to your account, as described in "WHAT INFORMATION DO WE COLLECT?" We delete it on request.)
- To determine the effectiveness of our marketing and promotional campaigns. We may process your information to better understand how to provide marketing and promotional campaigns that are most relevant to you. (Retention period: Marketing and website activity data is kept for as long as it remains useful for understanding which of our marketing works and for sending relevant onboarding and upgrade emails. Where possible, we aggregate or de-identify it. We delete it on request, and we stop tracking and delete the associated profile when you withdraw consent or unsubscribe, except that we keep your email on a suppression list so we can honor your opt-out.)
- To record and demonstrate your cookie choices. When you accept, reject, or change your cookie settings, we keep a record of your choice so we can honor it and show that we did. The record contains a random consent ID, which categories you accepted and rejected, the version of the banner, the date and time, which of our sites you used, and technical details such as your browser type, your approximate country, and any privacy signal your browser sent. If you are signed in, or sign in later, we link the record to your account. We do not store your IP address in these records. (Retention period: 3 years from the date of each record, after which it is deleted automatically. Because these records show that we honored your choices, we keep them for that period even if you ask us to delete your other data.)
- To save or protect an individual's vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.
3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?
In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.
If you are located in the EU or UK, this section applies to you.
The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:
- Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time. Learn more about withdrawing your consent.
- Performance of a Contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.
- Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to:
- Send users information about our products and services, including offers, which they can opt out of at any time
- Analyze how our Services are used so we can improve them to engage and retain users
- Support our marketing activities
- Diagnose problems and/or prevent fraudulent activities
- Understand how our users use our products and services so we can improve user experience
- Legal Obligations. We may process your information where we believe it is necessary for compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend our legal rights, or disclose your information as evidence in litigation in which we are involved.
- Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.
If you are located in Canada, this section applies to you.
We may process your information if you have given us specific permission (i.e., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time.
In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:
- If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way
- For investigations and fraud detection and prevention
- For business transactions provided certain conditions are met
- If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim
- For identifying injured, ill, or deceased persons and communicating with next of kin
- If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse
- If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province
- If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records
- If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced
- If the collection is solely for journalistic, artistic, or literary purposes
- If the information is publicly available and is specified by the regulations
- We may disclose de-identified information for approved research or statistics projects, subject to ethics oversight and confidentiality commitments

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
In Short: We may use cookies and other tracking technologies to collect and store your information.
We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

7. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?
In Short: We may transfer, store, and process your information in countries other than your own.
Our servers are located in the United States. Regardless of your location, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information (see "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?" above), including facilities in the United States, and other countries.
If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Policy and applicable law.
European Commission's Standard Contractual Clauses:
We have implemented measures to protect your personal information, including by using the European Commission's Standard Contractual Clauses for transfers of personal information between us and our third-party providers. These clauses require all recipients to protect all personal information that they process originating from the EEA or UK in accordance with European data protection laws and regulations. Our Data Processing Agreements that include Standard Contractual Clauses are available here: brandretriever.com/legal/dpa. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.

If you are located in the EU or UK, see section "HOW DO WE PROCESS YOUR INFORMATION?" for our retention periods by purpose.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. If a decision that produces legal or similarly significant effects is made solely by automated means, we will inform you, explain the main factors, and offer a simple way to request human review. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.
We will consider and act upon any request in accordance with applicable data protection laws.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. If you have questions or comments about your privacy rights, you may email us at notices@raleko.com.
12. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.
California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.
Analytics and marketing cookies on our websites run only if you turn them on in our cookie settings, so no browser signal is needed to keep them off.
13. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law. If you do not wish to provide the personal information necessary to fulfill their applicable purpose, it may affect our ability to provide our services, in particular:

- confirm your identity and protect your account

15. GOOGLE USER DATA
Google sign-in. If you sign in with Google, we receive your name, email address, and profile image, and use them to create and secure your account.
Google Drive. If your organization turns on Google Drive, you choose files in Google's own file picker, and we get access only to the files you pick. We download those files and send them to your Klaviyo image library at your direction. We don't keep copies of the files, keep ongoing access to your Drive, or store information about your Google account: the short-lived access Google gives us for each pick is held encrypted and deleted within minutes. We keep basic details about the files you import, such as names and sizes, so we can show where your images are used.
Sharing. We share Google user data only with Klaviyo when you import a file, with service providers that help us run BrandRetriever (see our Subprocessors), or when the law requires it.
Retention and deletion. The access Google gives us for a pick is deleted as soon as the pick is done, and always within minutes. You can also remove BrandRetriever's access at any time in your Google Account settings. Other information is kept and deleted as described in "HOW DO WE PROCESS YOUR INFORMATION?" above.
Limited Use. Our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements. We use Google user data only to provide the features you ask for. We do not sell it, use it for advertising, or use it to develop, improve, or train artificial intelligence or machine learning models. Our staff do not read it unless you give consent, it is needed for security purposes, or the law requires it.
16. CUSTOMER CONTENT AND OUR ROLE
When you connect Klaviyo and asset sources, we access content in those accounts on your behalf to provide the service. For that content we act as your processor under our Data Processing Agreement. This policy describes the information we handle as a controller: account, billing, and website visitor data.
17. WHAT WE READ AND WHAT WE KEEP
To show where images are used, we read your Klaviyo content, such as templates, forms, campaigns, and flows, and we keep only the image references and related names and statuses, not the content itself. Image files, whether from your computer or a connected source, are passed to Klaviyo and are not stored by us; we keep only metadata such as file names, sizes, and locations. We also keep how you organize your images in BrandRetriever, such as folders and favorites.
18. BROWSER EXTENSION
Our Chrome extension brings BrandRetriever into Klaviyo's image library. It runs only on klaviyo.com and on our own websites.
What it accesses. On klaviyo.com, the extension reads what it needs from the page you're working on, such as the Klaviyo account you're signed in to and the image library you have open, so it can show your connected sources and add the images you choose. It does not collect your browsing activity on other websites.
What it sends. The extension sends this information to our servers, using your BrandRetriever sign-in, to provide the service. It also sends usage and diagnostic information, such as which features are used, errors, and the extension version, to our analytics provider so we can keep the extension working and improve it. We collect this information to operate and secure the extension, whether or not you have accepted analytics cookies on our websites. If you've accepted analytics in the app, this is linked to your account, as described in "WHAT INFORMATION DO WE COLLECT?"
What it stores. The extension keeps a small amount of information in your browser, such as your sign-in status and a random identifier for your installation. Removing the extension deletes it.
Limited Use. The use of information received from the BrandRetriever extension complies with the Chrome Web Store User Data Policy, including the Limited Use requirements. We use it only to provide and improve BrandRetriever. We do not sell it, use it for advertising, or use it to determine creditworthiness or for lending.
19. STAFF ACCESS
A limited number of our staff can view account information to provide support. They can also view the service as a specific user for a limited time for troubleshooting. This access is restricted and logged.
20. TRACKING TECHNOLOGIES AND ADVERTISING
We do not display third-party advertising or use tracking technologies on our Services to tailor advertisements to you. Our service providers use these technologies only to provide analytics, security, and email-performance measurement to us and to personalize our emails. On our websites, analytics and marketing run only if you have accepted them in our cookie banner. Usage and error reporting in our browser extension is described in "BROWSER EXTENSION" above.
21. SESSION RECORDING
When you use the BrandRetriever app, including BrandRetriever's own panels shown inside Klaviyo by our browser extension (such as the Folders tab), we use a service provider (PostHog) to record how you interact with it. We record only BrandRetriever's own pages and panels, never the Klaviyo page around them. Recordings cover pages viewed, clicks, scrolling, mouse movements, and the text shown on the page, so we can understand how the product is used, find usability problems, and fix bugs. We configure recordings to always mask account and billing details shown on screen, such as names and email addresses, and anything typed into form fields, including passwords, and to block images, video, and embedded frames, so your files' thumbnails and previews are not recorded. Other text on the page may appear in recordings, which can include the names of items such as files and folders. Recordings are linked to your account. Recordings are kept for 30 days. Recording starts only after you accept analytics cookies in our cookie banner, and you can withdraw consent at any time using the Cookie settings link on our website or in the app. We do not record sessions on brandretriever.com, our marketing website; analytics and error reporting there also start only after you consent. We do not sell recordings or use them for advertising.
22. DO WE MAKE UPDATES TO THIS NOTICE?

We may update this Privacy Policy from time to time. The "Last updated" date at the top shows when it last changed. We may use your personal information for purposes compatible with those described in this Privacy Policy. If we plan to use your personal information for a purpose materially different from those described here, we will tell you before we do, and ask for your consent where the law requires it. For other material changes, we may notify you by email or in the Services.
